Reports we arrange

Personal injury medical reports

When a claimant is hurt in an accident at work, in a public place or on the road, the claim usually turns on independent medical evidence of the injury and its effects. Probita is an independent medical reporting organisation: you instruct us, and we instruct a suitably qualified independent expert to write the report.

What the report is for

A personal injury medical report gives the court an independent account of the claimant’s injuries: what they were, how they have affected the claimant’s daily life, work and leisure, whether they are consistent with the accident described, and what the outlook is. It also covers any treatment the expert recommends and whether there is a risk of problems later on.

We arrange personal injury medical reports for:

  • employer’s liability claims, such as slips, trips, falls and lifting injuries at work
  • public liability claims, such as tripping on a damaged pavement or an injury on someone else’s premises
  • road traffic claims that fall outside MedCo, for example where the injuries go beyond whiplash

Probita is not a MedCo-accredited medical reporting organisation. Initial reports in low-value whiplash claims arising from road traffic accidents must be sourced through MedCo, so we do not take those.

Who usually writes it

It depends on the injury. Orthopaedic surgeons often report on broken bones, joint and back injuries; GPs on less serious injuries that have settled or are settling; plastic surgeons on scarring; and other specialists where the injury calls for them. Some claims need more than one report.

We are building our panel of experts across specialties. Tell us what the claim needs and we will tell you who we can instruct.

What to send us

Send us, through the portal:

  • your letter of instruction, with the questions you want the expert to answer
  • the claimant’s GP records and any hospital, physiotherapy or other treatment records you hold
  • a short account of the accident and the date it happened
  • the claimant’s contact details, so we can arrange the appointment
  • any date the report is needed by

If a GP practice or hospital still has records you need, you can send them a secure upload link from the portal so they add the records straight to the case.

How we handle it

We check the instruction against the documents a personal injury claim needs and tell you straight away if anything is missing. We then instruct an independent expert, who confirms they have no conflict. The claimant receives a secure link to choose an appointment from the expert’s availability.

Before the appointment, the records are sorted, paginated and indexed, with a chronology and summary prepared for the expert: AI-prepared, expert-reviewed. The expert reads the records, examines the claimant and forms their own opinion. When the report comes in, it is checked against the personal injury checklist, including your questions and the Part 35 statements, and a person reviews anything flagged. It is then released to you through the portal, never by email.

Our secure portal is launching soon. Until then, instruct us by email and we’ll keep you updated on each case.

AI prepares the records for the expert: sorted, paginated and indexed, with a chronology and summary. It never forms or changes a medical opinion, and Probita gives none. The expert checks the summary against the records and the opinion is theirs alone, under their duty to the court.

We switch on each AI feature only once it has passed its own testing, and our team does the same work by hand until then.

Questions

Questions about personal injury reports

Do you take road traffic claims?

Yes, where the claim falls outside MedCo. We do not take initial reports in low-value whiplash claims, which must go through MedCo. If you are not sure which applies, tell us about the claim before instructing and we will say whether we can take it.

Can the claimant be seen by video?

Where the claim type allows and the expert agrees it is suitable. Most personal injury reports involve an examination in person.

What does a report cost?

One inclusive fee per report, with records review included. Ask us for our fee schedule.

What if the claimant’s condition has not settled when the report is written?

The expert may say that a further report is needed later, once the outlook is clearer. We can arrange that as an addendum or follow-up report with the same expert. See further evidence.
